Terms of Service

The agreement between you and Vaelmark, including the Game Rules every player accepts before playing.

1. Who we are and this agreement

Vaelmark (package com.vaelmark.game, the “Game”) is operated by Vaelmark Games (Ercan Doğan) (“we”, “us”). These Terms of Service, the Game Rules in section 4 and our Privacy Policy form the agreement between you and us.

You accept them when you create an account, or when you tap I UNDERSTAND & AGREE on the Game Rules screen that the Game shows before you can play. If you do not agree, please do not use the Game.

2. Who can play

You must be at least 13 years old. If you are under the age of majority where you live, a parent or legal guardian must agree to these Terms for you.

3. Your account

  • Your account is personal. Do not share, lend, sell or buy accounts.
  • You are responsible for everything that happens on your account, including anything done by another person you let use it.
  • Keep your sign-in details safe. Staff will never ask for your password.
  • Owning more than one account is allowed. Every account must follow the Game Rules, and all accounts you control or use share one penalty history (see section 5).

4. Game Rules

  1. Be respectful. Harassment, hate speech or abusive chat leads to a mute or ban.
  2. No cheating. Exploits, damage hacks or modified game clients lead to a permanent ban.
  3. No botting or automation. Accounts that use macros, scripts, auto-clickers or any tool that plays for you will be banned.
  4. Answer the anti-bot checks. Ignoring or failing them is treated as automation.
  5. One game session per device. Running several copies of the Game on one device, for example several emulator instances, is not allowed.
  6. Found a bug? Report it. Abusing a bug for gain is a bannable offense.
  7. No real-money trading. Selling gold, items or accounts for real money is forbidden.
  8. Account sharing and account selling are not allowed.
  9. Do not try to avoid a penalty, for example by playing on another account while one of your accounts is suspended.
  10. Staff will never ask for your password. Impersonating a GM or staff member is a permanent ban.
  11. Scamming other players in trades or the market is a bannable offense.
  12. Offensive character or clan names will be renamed or banned.

Breaking these rules can lead to a temporary or permanent ban without compensation.

5. How rules are enforced

Measures

Depending on what happened, we may warn you, disconnect a session, mute chat, rename a character, remove items or currency gained through a violation, or suspend accounts temporarily or permanently.

Automated systems and human decisions

Automated systems in the Game can disconnect a session, start an anti-bot check, make you wait before signing in again after a failed check, mute chat for 10 minutes after repeated blocked words, or refuse a session from an emulator or from a device already in use. Suspensions are decided by a staff member after reviewing the records. We do not explain how our detection works, because that would help people get around it.

Penalties follow the player

Penalties apply to the person, not only to one character. All accounts controlled or used by the same person share one penalty history, and a suspension may be applied to each of them. Otherwise anyone could avoid the next step by switching accounts.

Serious violations such as cheating, exploits, real-money trading, fraud or attacks on our servers can lead to a permanent ban straight away. We may choose a lighter or a heavier measure depending on how serious the violation is and on the player’s history.

6. Appeals

  • You may appeal a suspension once, within 30 days. Open a ticket on our Discord or email tsunade147@gmail.com, and include your character names.
  • A staff member reviews the records again and answers within 15 days.
  • The answer to your appeal is final. The same appeal sent again, or sent through other channels, is not reviewed again.

7. Virtual items and currency

Gold, gems, items, characters and other in-game content are licensed to you for use in the Game. They are not your property, have no value outside the Game and cannot be exchanged for money. We may change, rebalance or remove game content as the Game develops. When an account is suspended for breaking the rules, no compensation is given for its virtual items or currency.

8. Purchases

  • Purchases are processed by Google Play. Refunds follow Google Play’s refund policy. We may also refund at our discretion.
  • If a payment is refunded or charged back, the items it delivered may be removed.
  • Nothing in these Terms limits rights you have under the mandatory consumer protection laws of your country.

9. Changes to the Game and service availability

The Game is updated often and may be unavailable during maintenance. If we ever close the Game, we will announce it in the Game and on Discord at least 30 days before.

10. Ending this agreement

You can stop playing and delete your account at any time (how to delete your account). We may suspend accounts as described in section 5.

11. Liability

The Game is provided as it is. To the extent allowed by law, we are not responsible for indirect losses, or for losses caused by events outside our control. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Changes to these Terms

When we change these Terms or the Game Rules, we update the version and date at the top of this page and announce the change. The Game then shows the Game Rules screen again, and you accept the new version by tapping I UNDERSTAND & AGREE.

Vaelmark (pacote com.vaelmark.game, o “Jogo”) é operado por Vaelmark Games (Ercan Doğan) (“nós”). Estes Termos de Serviço, as Regras do Jogo da seção 4 e a nossa Política de Privacidade formam o acordo entre você e nós.

Você os aceita ao criar uma conta ou ao tocar em ENTENDI E CONCORDO (I UNDERSTAND & AGREE) na tela de Regras do Jogo que aparece antes de você poder jogar. Se você não concorda, por favor não use o Jogo.

2. Quem pode jogar

Você precisa ter pelo menos 13 anos. Se for menor de idade onde mora, um dos pais ou responsável legal precisa aceitar estes Termos por você.

3. Sua conta

  • Sua conta é pessoal. Não compartilhe, empreste, venda ou compre contas.
  • Você é responsável por tudo o que acontece na sua conta, inclusive pelo que outra pessoa fizer se você deixar que ela use a conta.
  • Mantenha seus dados de acesso em segurança. A equipe nunca pedirá sua senha.
  • Ter mais de uma conta é permitido. Toda conta deve seguir as Regras do Jogo, e todas as contas que você controla ou usa compartilham um único histórico de penalidades (veja a seção 5).

4. Regras do Jogo

  1. Seja respeitoso. Assédio, discurso de ódio ou chat abusivo levam a silenciamento ou banimento.
  2. Sem trapaça. Exploits, hacks de dano ou clientes modificados levam a banimento permanente.
  3. Sem bots ou automação. Contas que usam macros, scripts, auto-clickers ou qualquer ferramenta que jogue por você serão banidas.
  4. Responda às verificações anti-bot. Ignorá-las ou falhar nelas é tratado como automação.
  5. Uma sessão de jogo por dispositivo. Rodar várias cópias do Jogo em um dispositivo, por exemplo várias instâncias de emulador, não é permitido.
  6. Encontrou um bug? Reporte. Abusar de um bug para obter vantagem é passível de banimento.
  7. Sem comércio com dinheiro real. Vender ouro, itens ou contas por dinheiro real é proibido.
  8. Compartilhar e vender contas não é permitido.
  9. Não tente escapar de uma penalidade, por exemplo jogando em outra conta enquanto uma das suas contas está suspensa.
  10. A equipe nunca pedirá sua senha. Fingir ser um GM ou membro da equipe resulta em banimento permanente.
  11. Aplicar golpes em outros jogadores em trocas ou no mercado é passível de banimento.
  12. Nomes de personagem ou de clã ofensivos serão renomeados ou banidos.

Quebrar estas regras pode levar a banimento temporário ou permanente sem compensação.

5. Como as regras são aplicadas

Medidas

Dependendo do ocorrido, podemos advertir você, desconectar uma sessão, silenciar o chat, renomear um personagem, remover itens ou moedas obtidos com uma infração, ou suspender contas temporária ou permanentemente.

Sistemas automáticos e decisões humanas

Sistemas automáticos no Jogo podem desconectar uma sessão, iniciar uma verificação anti-bot, fazer você esperar antes de entrar de novo após falhar na verificação, silenciar o chat por 10 minutos após palavras bloqueadas repetidas, ou recusar uma sessão vinda de um emulador ou de um aparelho já em uso. As suspensões são decididas por um membro da equipe após analisar os registros. Não explicamos como funciona a nossa detecção, porque isso ajudaria a contorná-la.

As penalidades seguem o jogador

As penalidades se aplicam à pessoa, não apenas a um personagem. Todas as contas controladas ou usadas pela mesma pessoa compartilham um único histórico de penalidades, e uma suspensão pode ser aplicada a cada uma delas. Caso contrário, qualquer pessoa poderia evitar a próxima etapa trocando de conta.

Infrações graves, como trapaça, exploits, comércio com dinheiro real, fraude ou ataques aos nossos servidores, podem levar a banimento permanente imediato. Podemos escolher uma medida mais leve ou mais pesada conforme a gravidade da infração e o histórico do jogador.

6. Recursos

  • Você pode recorrer de uma suspensão uma vez, em até 30 dias. Abra um ticket no nosso Discord ou envie um e-mail para tsunade147@gmail.com, informando os nomes dos personagens.
  • Um membro da equipe analisa os registros novamente e responde em até 15 dias.
  • A resposta ao recurso é final. O mesmo recurso enviado de novo, ou por outros canais, não é analisado novamente.

7. Itens e moedas virtuais

Ouro, gemas, itens, personagens e outros conteúdos do Jogo são licenciados a você para uso no Jogo. Eles não são sua propriedade, não têm valor fora do Jogo e não podem ser trocados por dinheiro. Podemos alterar, rebalancear ou remover conteúdo conforme o Jogo evolui. Quando uma conta é suspensa por quebrar as regras, não há compensação pelos seus itens ou moedas virtuais.

8. Compras

  • As compras são processadas pelo Google Play. Os reembolsos seguem a política de reembolso do Google Play. Também podemos reembolsar a nosso critério.
  • Se um pagamento for reembolsado ou contestado, os itens entregues por ele podem ser removidos.
  • Nada nestes Termos limita os direitos que você tem pelas leis obrigatórias de defesa do consumidor do seu país.

9. Mudanças no Jogo e disponibilidade

O Jogo é atualizado com frequência e pode ficar indisponível durante manutenções. Se um dia encerrarmos o Jogo, avisaremos no Jogo e no Discord com pelo menos 30 dias de antecedência.

10. Fim deste acordo

Você pode parar de jogar e excluir sua conta a qualquer momento (como excluir sua conta). Podemos suspender contas conforme a seção 5.

11. Responsabilidade

O Jogo é fornecido no estado em que se encontra. Na medida permitida por lei, não somos responsáveis por perdas indiretas ou por perdas causadas por eventos fora do nosso controle. Nada nestes Termos exclui uma responsabilidade que a lei não permite excluir.

12. Mudanças nestes Termos

Quando mudarmos estes Termos ou as Regras do Jogo, atualizaremos a versão e a data no topo desta página e anunciaremos a mudança. O Jogo então mostra novamente a tela de Regras do Jogo, e você aceita a nova versão tocando em ENTENDI E CONCORDO (I UNDERSTAND & AGREE).

1. Biz kimiz ve bu sözleşme

Vaelmark (paket com.vaelmark.game, “Oyun”) Vaelmark Games (Ercan Doğan) (“biz”) tarafından işletilir. Bu Kullanım Şartları, 4. bölümdeki Oyun Kuralları ve Gizlilik Politikamız seninle aramızdaki sözleşmeyi oluşturur.

Hesap oluşturduğunda ya da oynamadan önce gösterilen Oyun Kuralları ekranında OKUDUM, KABUL EDİYORUM (I UNDERSTAND & AGREE) düğmesine dokunduğunda bunları kabul etmiş olursun. Kabul etmiyorsan lütfen Oyunu kullanma.

2. Kimler oynayabilir

En az 13 yaşında olmalısın. Yaşadığın yerde reşit değilsen, bu Şartları senin adına bir ebeveyn ya da yasal vasi kabul etmelidir.

3. Hesabın

  • Hesabın kişiseldir. Hesap paylaşma, ödünç verme, satma ya da satın alma.
  • Hesabında olan her şeyden, kullanmasına izin verdiğin başka birinin yaptıkları dahil, sen sorumlusun.
  • Giriş bilgilerini güvende tut. Ekip senden asla şifreni istemez.
  • Birden fazla hesabın olabilir. Her hesap Oyun Kurallarına uymalıdır ve kontrol ettiğin ya da kullandığın tüm hesaplar tek bir ceza geçmişini paylaşır (5. bölüm).

4. Oyun Kuralları

  1. Saygılı ol. Taciz, nefret söylemi ya da küfürlü sohbet susturma veya ban ile sonuçlanır.
  2. Hile yasak. Açık kullanımı, hasar hilesi ya da değiştirilmiş oyun istemcisi kalıcı ban demektir.
  3. Bot ve otomasyon yasak. Makro, betik, otomatik tıklayıcı ya da senin yerine oynayan herhangi bir araç kullanan hesaplar banlanır.
  4. Anti-bot kontrollerini cevapla. Görmezden gelmek ya da başarısız olmak otomasyon sayılır.
  5. Cihaz başına tek oyun oturumu. Bir cihazda Oyunun birden fazla kopyasını çalıştırmak, örneğin birden fazla emülatör penceresi, yasaktır.
  6. Hata mı buldun? Bildir. Bir hatayı kazanç için kullanmak ban sebebidir.
  7. Gerçek parayla ticaret yasak. Altın, eşya ya da hesabı gerçek parayla satmak yasaktır.
  8. Hesap paylaşımı ve hesap satışı yasaktır.
  9. Cezadan kaçmaya çalışma; örneğin hesaplarından biri askıdayken başka bir hesapla oynamak.
  10. Ekip asla şifreni istemez. GM ya da ekip üyesi taklidi kalıcı bandır.
  11. Takasta ya da pazarda diğer oyuncuları dolandırmak ban sebebidir.
  12. Saldırgan karakter ya da klan adları değiştirilir veya banlanır.

Bu kuralları çiğnemek, tazminatsız geçici ya da kalıcı bana yol açabilir.

5. Kurallar nasıl uygulanır

Önlemler

Olaya göre uyarı verebilir, bir oturumu düşürebilir, sohbeti susturabilir, karakter adını değiştirebilir, ihlalle kazanılan eşya veya parayı geri alabilir ya da hesapları geçici veya kalıcı olarak askıya alabiliriz.

Otomatik sistemler ve insan kararı

Oyundaki otomatik sistemler bir oturumu düşürebilir, anti-bot kontrolü başlatabilir, başarısız bir kontrolden sonra yeniden girmeden önce bekletebilir, tekrarlanan engelli kelimelerden sonra sohbeti 10 dakika susturabilir ya da emülatörden veya zaten kullanımda olan bir cihazdan gelen oturumu reddedebilir. Askıya alma kararlarını bir ekip üyesi kayıtları inceledikten sonra verir. Tespit sistemimizin nasıl çalıştığını açıklamayız, çünkü bu onu atlatmaya yardım eder.

Ceza oyuncuya uygulanır

Cezalar yalnız bir karaktere değil kişiye uygulanır. Aynı kişinin kontrol ettiği ya da kullandığı tüm hesaplar tek bir ceza geçmişini paylaşır ve askıya alma her birine uygulanabilir. Aksi halde herkes hesap değiştirerek bir sonraki basamaktan kaçabilirdi.

Hile, açık kullanımı, gerçek parayla ticaret, dolandırıcılık ya da sunucularımıza saldırı gibi ağır ihlaller doğrudan kalıcı bana yol açabilir. İhlalin ağırlığına ve oyuncunun geçmişine göre daha hafif ya da daha ağır bir önlem seçebiliriz.

6. İtiraz

  • Bir askıya almaya 30 gün içinde bir kez itiraz edebilirsin. Discord sunucumuzda ticket aç ya da tsunade147@gmail.com adresine karakter adlarınla birlikte yaz.
  • Bir ekip üyesi kayıtları yeniden inceler ve 15 gün içinde cevap verir.
  • İtirazın cevabı kesindir. Aynı itirazın tekrar ya da başka kanallardan gönderilmesi yeniden incelenmez.

7. Sanal eşya ve para

Altın, gem, eşyalar, karakterler ve diğer oyun içerikleri sana Oyunda kullanman için lisanslanır. Senin mülkün değildir, Oyun dışında değeri yoktur ve paraya çevrilemez. Oyun geliştikçe içerikleri değiştirebilir, dengeleyebilir ya da kaldırabiliriz. Bir hesap kural ihlali nedeniyle askıya alındığında sanal eşya ve paraları için tazminat verilmez.

8. Satın almalar

  • Satın almalar Google Play üzerinden yapılır. İadeler Google Play iade politikasına tabidir. Kendi takdirimizle de iade yapabiliriz.
  • Bir ödeme iade edilir ya da itiraz edilirse, o ödemeyle verilen eşyalar geri alınabilir.
  • Bu Şartlardaki hiçbir şey, ülkendeki zorunlu tüketici koruma yasalarından doğan haklarını sınırlamaz.

9. Oyundaki değişiklikler ve erişilebilirlik

Oyun sık güncellenir ve bakım sırasında erişilemeyebilir. Oyunu bir gün kapatırsak bunu en az 30 gün önceden Oyunda ve Discord'da duyururuz.

10. Sözleşmenin sona ermesi

İstediğin zaman oynamayı bırakıp hesabını silebilirsin (hesabını nasıl silersin). Hesapları 5. bölümde anlatıldığı gibi askıya alabiliriz.

11. Sorumluluk

Oyun olduğu gibi sunulur. Yasanın izin verdiği ölçüde dolaylı kayıplardan ya da kontrolümüz dışındaki olayların yol açtığı kayıplardan sorumlu değiliz. Bu Şartlardaki hiçbir şey, yasanın hariç tutulmasına izin vermediği bir sorumluluğu hariç tutmaz.

12. Bu Şartlardaki değişiklikler

Bu Şartları ya da Oyun Kurallarını değiştirdiğimizde bu sayfanın üstündeki sürümü ve tarihi güncelleriz ve değişikliği duyururuz. Oyun, Oyun Kuralları ekranını yeniden gösterir ve yeni sürümü OKUDUM, KABUL EDİYORUM (I UNDERSTAND & AGREE) düğmesine dokunarak kabul edersin.
